Terms of Use

1. Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Aero Prime Ventures LLC d/b/a HiringSky ("Company," "we," "our," or "us"), a Florida limited liability company, governing your access to and use of the HiringSky web application and all related services (collectively, the "Service").

By creating an account, clicking "I agree," or otherwise accessing or using any part of the Service, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify you of material changes by email and by posting an updated version with a new effective date. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are 18 years of age or older, you have the legal capacity to enter into a binding contract, and all registration information you submit is truthful, accurate, current, and complete.

Users between the ages of 13 and 17 may only access the Service with verifiable parental or legal guardian consent. If you are a parent or guardian providing consent for a minor, you agree to be bound by these Terms on behalf of that minor and are responsible for their use of the Service.

The Service is intended for personal career development and job search purposes by individual users. It is not intended for use by recruitment agencies, staffing firms, HR consultants, or any entity using the Service on behalf of third parties, without our express written consent.

3. Account Registration and Security

To access the Service, you must create an account. You agree to provide accurate, complete, and current information during registration — including your email address and a first name used to personalize your experience — and to update your information to keep it accurate and current.

You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You agree not to share your password with any third party and to notify us immediately at contact@hiringsky.com upon becoming aware of any unauthorized use of your account or any other breach of security.

We will not be liable for any losses resulting from unauthorized access to your account arising from your failure to adequately protect your credentials. You may be held liable for losses incurred by the Company or other users due to unauthorized access to your account.

One account per person. You may not create multiple accounts to circumvent service limits, account suspensions, or other restrictions.

4. Free Service and Scope

4.1 Free of Charge

HiringSky is currently offered free of charge to job seekers. There is no paywall, subscription, or one-time purchase required to access any feature of the Service. We do not collect payment information from users.

We reserve the right to introduce paid tiers, premium features, or paid services in the future. If we do, we will provide reasonable advance notice and any new pricing structure will apply only to features added under it. Features described in Section 4.2 above will remain free for users who registered before any pricing change unless we expressly state otherwise with notice.

4.4 Service Availability

The Service depends on third-party infrastructure (Anthropic, Supabase, JSearch / OpenWeb Ninja, Vercel) that we do not control. We make no guarantee of uninterrupted service. The Service may be unavailable from time to time for maintenance, upgrades, or due to third-party outages. See Section 18 (Force Majeure) for more.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

We reserve the right to terminate or suspend your account immediately for violations of this section, at our sole discretion, without prior notice.

6. AI-Generated Content — Rights and Limitations

HiringSky uses Claude by Anthropic, PBC to generate the career positioning, resume, search strategy, recruiter messages, coaching, and role-fit content within the Service. All AI-generated content is generated in response to your specific inputs and is intended solely for your personal career development use.

6.1 No Professional Advice

AI-generated content provided through the Service is for informational and personal career development purposes only. It does not constitute, and should not be relied upon as, professional legal advice, financial advice, employment advice, or professional career counseling. HiringSky is not a law firm, financial advisor, or licensed employment agency.

6.2 Accuracy and Limitations

AI language models can and do produce inaccurate, incomplete, or outdated information. You acknowledge that AI-generated content may contain errors, hallucinations, or statements that are factually incorrect. You are solely responsible for reviewing, verifying, editing, and deciding whether to use any AI-generated content before submitting it to prospective employers or using it for any professional purpose.

6.3 No Employment Guarantee

The Service provides AI-generated career positioning content and surfaces public job postings via third-party aggregation. Employment outcomes depend on numerous factors entirely outside the Company's control, including but not limited to: labor market conditions; employer hiring decisions and internal processes; the accuracy and completeness of information you provide; how you choose to use, edit, or present the AI-generated content; your qualifications, experience, and interview performance; industry-specific requirements, certifications, or licensing; economic conditions, company budgets, and hiring freezes; and competition from other candidates.

Any testimonials, case studies, success metrics, or outcome data displayed on the Service or in marketing materials represent individual experiences and are not guarantees of future results. Past performance of other users does not predict your results.

By using the Service, you acknowledge and agree that you are solely responsible for your job search decisions and outcomes, and that HiringSky's role is limited to providing AI-generated career content tools and surfacing publicly available job postings for your personal use.

6.4 AI Disclosure

In compliance with applicable FTC guidance on AI transparency, you acknowledge that you have been informed that all sprint module outputs, coaching responses, and role fit analyses are generated by AI (Claude by Anthropic) and may contain inaccuracies.

7. Matched Job Openings and Job Posting Data

The Matched Job Openings feature surfaces current job postings from third-party sources via OpenWeb Ninja's JSearch API. You acknowledge and agree to the following with respect to this feature:

7.1 Third-Party Data

Job postings displayed in the Matched Job Openings feature are created and published by employers and aggregated by third parties. HiringSky does not author, verify, endorse, or guarantee the accuracy, currency, completeness, or legitimacy of any individual job posting. Postings may be outdated, filled, mis-categorized, or in some cases fraudulent. You are solely responsible for evaluating any opportunity before applying.

7.2 No Endorsement

The appearance of an employer's job posting in your matched roles does not constitute an endorsement, partnership, affiliation, or business relationship between HiringSky and that employer. HiringSky has no relationship with employers whose postings are surfaced through JSearch.

7.3 Fit Ratings

Fit ratings ("Strong fit," "Worth a look," "Stretch") are AI-generated assessments of alignment between your lane positioning and a role's stated requirements. They reflect alignment, not the likelihood of a callback or hire. A "Strong fit" rating does not mean you will be interviewed or hired; a "Stretch" rating does not mean you cannot succeed in that role. You should evaluate each role on its own merits regardless of its rating.

7.4 Apply Destinations

When you click "Apply" on a matched role, you will be redirected to a third-party website (the employer's careers page, an applicant tracking system, or a major job board). Once you leave HiringSky, your interaction with that third-party site — including any account creation, data you submit, or application you complete — is governed by that third party's terms and privacy practices, not ours.

7.5 Refresh Behavior

Matched job openings refresh when you visit the Matched Job Openings view. Fresh results are merged with your existing tracker entries; roles you have already engaged with (kept, applied, interviewing, etc.) are preserved across refreshes. Roles you have not engaged with may be replaced when newer postings become available.

8. Talent Network

The HiringSky Talent Network is an optional, future-facing feature. By opting in, you authorize HiringSky to store a limited set of profile fields for the purpose of making your profile discoverable to employers when the employer-facing feature launches.

8.1 Voluntary Participation

Opting into the Talent Network is entirely voluntary. You may decline to opt in at any time without any effect on your access to the Service. You may withdraw an existing opt-in at any time through your account settings.

8.2 Currently Stored Only

At the effective date of these Terms, the Talent Network employer-facing feature has not yet launched. Opting in today means your consented profile fields are stored in your account in preparation for that future feature. Until the feature launches, no employer or third party can view your profile through the Talent Network.

8.3 Two-Stage Consent

If and when the employer-facing feature launches, the Talent Network will operate on a two-stage consent model:

  1. Discoverability: By opting in, you consent to having a limited set of profile fields (current role, target roles, target industries, location, salary range) made visible to vetted employers.
  2. Outreach acceptance: Your name, email, and contact information remain hidden from employers until an employer expresses interest and you separately accept their outreach. Only then will your identity be revealed to that specific employer.

8.4 Forward-Looking Statements About Employers

We intend to vet employers before granting Talent Network access and to require employers to respond to candidate applications within a defined time period (anticipated to be 14 days). These employer standards are forward-looking and not currently enforced because the employer-facing feature has not launched. They describe our intent, not a current contractual guarantee.

8.5 No Resale

HiringSky will not sell, license, or resell Talent Network profile data to third parties, including employers. Employer access (when launched) will be governed by separate employer terms prohibiting data harvesting, resale, or use for any purpose other than direct hiring outreach.

9. Intellectual Property

The Service, including its design, user interface, software, underlying technology, branding, trademarks, and all original content created by the Company (excluding your personal content), is owned by Aero Prime Ventures LLC and is protected by applicable United States and international copyright, trademark, trade secret, and other intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial career development purposes. This license does not include the right to sublicense, modify, adapt, translate, reverse engineer, or create derivative works of the Service.

The "HiringSky" name, logo, and associated marks are trademarks or trade names of Aero Prime Ventures LLC. You may not use our trademarks without our prior written consent.

AI-generated outputs created from your inputs are yours to keep and use for your personal career development. You may not, however, claim authorship of the underlying AI model, the prompt engineering, the lane-fork methodology, or any other proprietary aspect of how the Service produces its outputs.

10. Your Content and License Grant

You retain full ownership of all personal content you submit to the Service, including your intake questionnaire answers, resume text, job descriptions, AI Coach messages, and Application Tracker data ("Your Content").

By submitting Your Content to the Service, you grant Aero Prime Ventures LLC a limited, non-exclusive, worldwide, royalty-free license to: store, reproduce, and transmit Your Content for the sole purpose of providing the Service to you; transmit Your Content to our AI provider (Anthropic) for AI content generation; transmit lane-derived query parameters to our job posting data provider (JSearch / OpenWeb Ninja) for job matching; and maintain backups of Your Content for data integrity and recovery purposes.

This license is limited to providing the Service to you personally. We will not use Your Content for any other purpose, including training AI models, marketing, or providing services to third parties. This license terminates when you delete your account and request deletion of your data.

You represent and warrant that you own or have the necessary rights to submit Your Content, and that Your Content does not violate the intellectual property rights, privacy rights, or other rights of any third party.

11. Privacy and Data Practices

Your use of the Service is subject to our Privacy Policy, available at app.hiringsky.com/privacy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

11.1 No Third-Party Data Sale

HiringSky does not sell, rent, lease, trade, or otherwise disclose your personal data to third parties for their marketing, advertising, or commercial purposes. Your resume, intake answers, career strategy outputs, AI coach conversations, and other personal content remain yours and are never sold to advertisers, data brokers, recruiters, or employers.

11.2 Service Providers

Your data is transmitted to the following service providers solely for the purpose of operating the Service:

We do not use any third-party analytics trackers, advertising pixels, retargeting cookies, or behavioral tracking tools. We do not integrate with Facebook Pixel, Google Analytics advertising features, or any similar advertising or surveillance technology.

11.3 Anonymous Internal Metrics

We collect anonymous, non-personally-identifiable usage events (such as "module completed" or "lane chosen") for internal product improvement purposes only. These events contain no personal information — no names, email addresses, resume content, or intake answers — and cannot be used to identify you.

12. Third-Party Services and Links

The Service contains links to third-party websites, job postings, employer career pages, and professional platforms (such as LinkedIn). These links are provided so you can apply to or research opportunities surfaced in your lane. The Company has no control over the content, privacy policies, or practices of third-party sites and accepts no responsibility for them.

The Service integrates with third-party service providers including Anthropic, OpenWeb Ninja (JSearch), Supabase, Resend, and Vercel. Your use of those services is subject to their respective terms of service and privacy policies. Your relationship with those providers is independent of your relationship with HiringSky.

13. Termination

13.1 Termination by You

You may terminate your account at any time by using the account deletion function in your profile settings or by contacting us at contact@hiringsky.com.

13.2 Termination by Us

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to: violation of these Terms; fraudulent, abusive, or illegal activity; extended inactivity; or our decision to discontinue the Service or any part of it.

13.3 Effect of Termination

Upon termination, your license to use the Service immediately terminates. We may delete your account data in accordance with our data retention policy described in the Privacy Policy. Provisions of these Terms that by their nature should survive termination — including Sections 6, 9, 10, 14, 15, 16, and 17 — shall survive.

14. Disclaimer of Warranties

No advice or information, whether oral or written, obtained from the Company or through the Service will create any warranty not expressly stated in these Terms.

15. Limitation of Liability

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless Aero Prime Ventures LLC and its members, officers, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: your use of the Service; your violation of these Terms; your violation of any applicable law or regulation; your infringement of any intellectual property or other rights of any third party; or the content you submit to the Service.

17. Governing Law and Dispute Resolution

17.1 Governing Law

These Terms and any dispute arising from or related to them or the Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

17.2 Binding Arbitration

Except for disputes that qualify for small claims court, you and the Company agree that any dispute, claim, or controversy arising from or relating to these Terms, the Service, or your relationship with the Company — including but not limited to questions of whether a claim is subject to arbitration — shall be settled by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as amended from time to time.

Arbitration shall be conducted in Miami-Dade County, Florida, or by videoconference, at the arbitrator's discretion. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

17.3 Class Action Waiver

17.4 Opt-Out

You may opt out of binding arbitration within 30 days of first accepting these Terms by sending a written notice to contact@hiringsky.com with the subject line "Arbitration Opt-Out." If you opt out, any disputes will be resolved in the state or federal courts located in Miami-Dade County, Florida, and you and the Company consent to personal jurisdiction in those courts.
